你这么说,就是你理解错误了。TOS等于合同的内容,本来就很重要。每个客户在付款之前都需要同意的,不存在别人搬出POLICY来压客户的说法。只是在国内,我们自己不把合同当回事,所以习惯了不正规的做事方法,而别人正规的反而觉得不对了。如果你觉得他们的POLICY是随意订立的,那么可以当初不同意不付款买产品的。如果同意了,付款了,最后又说人家的POLICY很随意,那就自己吃亏也没的说了。。。。
而根据TOS的规定,ABUSE警告就是可能关闭账号的警告,如果他给了你几次ABUSE的警告,你还不领情,反而说他态度有问题,他不理睬你非常正常。
不知道SHOCK当时是怎么帮楼主去谈判的,希望不是按你上面的思路去做的,否则我不难想象为什么别人只给你自动回复了,没有BAN你就算客气了。。。。
关于你说的最后那种情况,我不太清楚是什么公司。但现在包括GODADDY之类的很多正规公司都会在TOS进行任何的修改之后,立即发EMAIL通知所有客户的。其原因,还是因为TOS是合同的重要内容。如果TOS修订后,你不同意,可以马上向他们提出,他们一般都会尊重你的意见,取消双方的合作。所以,出了问题后,为TOS的修订争论的事情,我也很少听到美国正规IDC出现过。
你去留意一下你的tos吧,保证有他们可以随意修改这一条。正因为是在外国,消费者的权利通常都更加大,不像国内那样可以随便欺压消费者。你说的他们的警告,根据楼主转给我的回复,就是上一个帖子上的两句话,我不觉得他们当时有任何警告删除账户的意图。就算policy写明了abuse会停账号,但是也不应该立刻就删了数据给别人用。感觉就像坑人一样。
我并没有去谈判什么,之前说的他们没有回复和自动回复的是楼主自己发的ticket。后来我把楼主的情况向他们说了一下,问能不能要回数据,开始几次他们的回复简直就是自动回复。
楼主说开始发了几次ticket说要回数据。没给理会,直接关ticket了,根本没有给过楼主一个答复究竟数据拿不拿的回来。我就给建议楼主这样写:
Sorry for causing the problem to your network. My server had been hacked and was infected virus.
I am not going to run the server any more, but there is very important data on the server. I wonder if I can download my data. It would be grateful if you could turn on the server for a couple of hours (you can block the 80 port) or shift my data to a safe place for me to download.
Thanking you in advance.
意思是对于之前的abuse道歉,说是被hack了病毒。现在不打算再用服务器,只是想拿回数据。
我的态度已经非常的礼貌向他们问清情况。楼主发过去之后,还是没有回复,然后就回复了一句 Sorry but server's been terminated due to multiple abuse。这样的话算回复么,只说terminated,完全没有回答data的事。然后他们就把ticket关了。
然后我建议楼主再发一次:I wonder if my data is still there and if I can download the data.然后对方还是一模一样的一句话Sorry but server's been terminated due to multiple abuse。
然后我打他们的电话,没人听,美国时间凌晨,不知道是没上班还是什么。不过可以肯定的说,他们没有人24小时值班的。等到那边8点多,得到了下面的回复:
Please refer to our Policies/SLA about termination due to abuse and refund policies. No refund, no prorate. We've been more than fair giving you a 2nd chance when we enabled the server, but you continue abusing it 2-3 times more after we enabled it. And you got a few hours there after we enabled the server to really got your data. Now it is gone already, we've recycled it for other clients
“Now it is gone already, we've recycled it for other clients” 他们终于给出结果了,语气还真不当回事的,马上就把机器给别人用了。
然后我们都觉得已经是没戏了。楼主然后跟他们说不给数据就投诉到底。之后他们回复一下:
Then you should not have done any abuse to our network, the first 2-3 times, we let it go and still enabled the server for you, but when it happnened again for 2-3 more times, we just cannot keep the server enabled. It just would not be fair to other clients as your abuse caused packet loss/downtimes to other servers sharing the network.
It is clear in our policies that any abuse/attempt to undermine our network will result in termination of the account.
其实他们就给了一次机会,而且还是在没有警告说要删数据的情况下。这下他们也急了,回复的很快。
然后我说:
you can terminate my account, but you have no right to remove my data. I have paid for the whole year for the server. You should keep my data in the server although you stop the server. You must pay for the loss of my important data, since I have very imnport client data there.
他们回复:
We're NOT responsibile for any loss of data, it is clearly stated in our policies/SLA. You are responsible to keep backup of your data and keep your data safe.
这句话推的一干二净,当然用户是要自己负责数据的备份,但是觉得他们对于用户的数据不当一回事。
然后我说You did not give me any warning that you will remove my data.And you never ask me to backup the latest data before you remove my data. This is absolutely your fault.说他们在删除数据处理不当。
大家都知道没戏了。楼主的paypal过了45天申诉期,说要去WHT喷他,然后我说如果不爽的话就这样跟他们说,去吼一吼他
If you can not recovery my data or you do not do any compensation, I promise you will have a bad reputation in WHT. This is not to threaten you, but I just want to let anybody know the true of how you dealing with your client's important data. 吼他说要到WHT喷他。
楼主最终很勇敢的发了过去
然后不知道是什么时候得到了这样的回复
You abused, server's terminated, it's as simple as that. Do not abuse then we're not gonna terminate the account. We did give you a 2nd chance but you continue with the abuse so we had no choice
”it's as simple as that.“ 很轻蔑的态度。就让他不爽去吧。
最后我对楼主说,没什么好说了。fuck他吧。
所以我之前问楼主fuck他了没
